Brain & Body Recess™ – Terms & Conditions
Effective Date: August 28, 2025

By booking, reserving, purchasing, or participating in any appointment, service, package, event, or workshop with Brain & Body Recess™ (“Company,” “we,” “our,” or “us”), the client (“you” or “your”) automatically acknowledges and agrees to be bound by these Terms & Conditions and related policies in full.

1. Eligibility & Account Use
1.1 In order to use our website, create an account, and/or receive services, you must be at least eighteen (18) years of age or the legal age of majority in your jurisdiction, whichever is higher.
1.2 By creating an account, booking a service, or making a purchase, you represent and warrant that you:

Have the legal authority, right, and freedom to enter into these Terms as a binding agreement.

Are not prohibited from using our services or website under any applicable law or regulation.
1.3 Creating an account, booking a service, or making a purchase constitutes your legally binding agreement to these Terms & Conditions.

2. Company Rights
2. Company Rights
We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.
2.1 Right to Refuse Service
Brain & Body Recess™ reserves the right to refuse service to any client at any time, with or without cause, including but not limited to circumstances involving inappropriate behavior, safety concerns, or failure to comply with Company policies.
2.2 Cancellation of Appointments, Packages, and Subscriptions
The Company retains the sole discretion to cancel, suspend, or terminate any appointment, package, subscription, or scheduled service if:
a. The client is in bad financial standing with the Company;
b. The client has unpaid balances, overdue invoices, or outstanding bills exceeding seven (7) calendar days past the due date; or
c. The client engages in conduct deemed inappropriate, unsafe, or otherwise in violation of these Terms & Conditions.
2.3 Effect of Termination
In the event of cancellation or termination under this section, the Company shall not be liable for any damages, losses, or inconvenience incurred by the client. Any prepaid sessions or services may be forfeited at the Company’s discretion, subject to applicable law.
3. Warranties & Responsibility for Services
3.1 All services are provided “as is” and “as available” without warranties of any kind, either express or implied.
3.2 By booking or participating in any service, you acknowledge and agree that:

Brain & Body Recess™ shall not be liable for any injury, loss, accident, or outcome related to or arising from your participation in services.

You voluntarily assume all risks associated with the services you receive.

You release and discharge Brain & Body Recess™, its owners, employees, contractors, and affiliates from any and all claims, liabilities, damages, or demands, whether known or unknown.
3.3 Clients are solely responsible for their own health, safety, and decision-making when engaging in services.

4. Intellectual Property & Ownership

4.1 All service materials, including but not limited to software, images, text, graphics, logos, trademarks, service marks, copyrights, patents, photographs, audio, video, music, and any related intellectual property rights, are and shall remain the exclusive property of Brain & Body Recess™.
4.2 Except as explicitly provided in these Terms, no license or right is granted to you in or under any intellectual property rights of Brain & Body Recess™.
4.3 You agree not to:

Sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from any Brain & Body Recess™ intellectual property.

Use our intellectual property in a way that could damage, disparage, or misrepresent our brand or services.
5. Cancellation & No-Show Policy
This Cancellation & No-Show Policy (“Policy”) sets forth the terms and conditions governing all appointments, services, events, and workshops at Brain & Body Recess™ (“Company,” “we,” “our,” or “us”). By scheduling an appointment or reserving services, the client (“you” or “your”) acknowledges and agrees to the terms of this Policy.

Article I. Definitions

Standard Services: Any single appointment with a scheduled duration of ninety (90) minutes or less.

Extended Services: Any single appointment with a scheduled duration exceeding ninety (90) minutes.
-
Couples Services: Services reserved for exactly two (2) individuals under one booking.

Multi-Service Blocks: Any reservation consisting of two (2) or more services booked consecutively for a single client or party.
-
Groups, Events, and Workshops: Any reservation consisting of three (3) or more participants.
-
Late Arrival: A client arriving more than fifteen (15) minutes after the scheduled start time of an appointment.
-
No-Show: A client failing to attend a scheduled appointment without proper notice as defined herein.
Article II. Cancellation Deadlines and Fees

Standard Services
a. Cancellation or rescheduling single person appointments with at least twenty-four (24) hours’ notice: No fee.
b. Cancellation within twenty-four (24) to twelve (12) hours of appointment: Fee equal to fifty percent (50%) of the scheduled service.
c. Cancellation within fewer than twelve (12) hours or failure to attend: Fee equal to one hundred percent (100%) of the scheduled service and in the event of sessions booked from bought packages the service is deducted from the package total unless said otherwise by the business. The outcome is at full discretion of the business. -
Extended Services (Longer than 90 minutes), Couples Services, and Multi-Service Blocks
a. Cancellation or rescheduling with at least forty-eight (48) hours’ notice: No fee.
b. Cancellation within forty-eight (48) to twenty-four (24) hours of appointment: Fee equal to fifty percent (50%) of the scheduled service.
c. Cancellation within fewer than twenty-four (24) hours or failure to attend: Fee equal to one hundred percent (100%) of the scheduled service. -
Groups, Events, and Workshops
a. A non-refundable deposit of fifty percent (50%) of the reserved services is required at the time of booking.
b. Cancellation or rescheduling with at least seventy-two (72) hours’ notice: Deposit may be eligible to be used on a different booking if group event is rescheduled and booked within 30 days after the original appointment. Cancellation with fewer than seventy-two (72) hours’ notice or failure to attend: Fee equal to one hundred percent (100%) of the reserved services.
Article III. Late Arrivals

Rooms are held for fifteen (15) minutes beyond the scheduled appointment time.

If the client arrives within this window, the session may be shortened to end at the originally scheduled time, with full fee due.

If the client arrives later than fifteen (15) minutes, Brain & Body Recess™ reserves the right to classify the appointment as a “no-show,” with fees assessed pursuant to Article II.

Article IV. Exceptions and Courtesy Waivers

Each client is entitled to one (1) courtesy waiver of fees under this Policy per calendar year.

In cases of verified emergencies, illness, or extreme weather, cancellation fees shall be waived if the appointment is rescheduled within thirty (30) days of the original appointment date.

The responsibility to contact Brain and Body Recess and reschedule an appointment within 30 business days is solely on the client.

Article V. Equity and Compliance

Clients covered by Apple Health or Medicaid are exempt from cancellation and no-show fees, in compliance with Washington State law.

For clients receiving services covered by Washington State Department of Labor & Industries (Workers’ Compensation), missed appointment fees are not billable to L&I. If this Policy has been disclosed prior to booking, the client may be held personally responsible for fees.

Article VI. Payment Terms

A valid credit or debit card on file is required to confirm and hold all appointments.

All cancellation and no-show fees will be charged automatically to the card on file.

Clients with prepaid sessions or packages will have the applicable session deducted from their balance in lieu of a cancellation or no-show fee.

Article VII. Acknowledgment and Enforcement
By reserving an appointment or participating in services at Brain & Body Recess™, you agree to comply with this Policy in its entirety. This Policy shall be binding, and all fees assessed hereunder are enforceable as a condition of continued service.
6. Refund Policy
This Refund Policy (“Policy”) applies to all appointments, subscriptions, packages, services, and products purchased through Brain & Body Recess™ (“Company,” “we,” “our,” or “us”). By making a purchase, you (“Client,” “you,” or “your”) acknowledge and agree to the terms below.
6.1 General Policy
6.1.1. All sales are considered final unless expressly stated otherwise in this Policy.
6.1.2. Refund requests must be submitted in writing (email or official request form). Phone, text, or verbal requests are not accepted as valid notice.
6.1.3. Processing time for approved refunds may take up to ten (10) business days, and refunds will be issued to the original form of payment only.
6.1.4. Any applicable transaction fees charged by third-party processors (e.g., Stripe, Square, credit card issuers) are non-refundable.
6.1.5. Tips and gratuities are non-refundable under all circumstances.
6.1.6. Clients with outstanding balances more than thirty (30) calendar days past due are ineligible for refunds, credits, or new bookings until all overdue amounts are paid in full.
6.2. Refunds for À la Carte / One-Time Appointments
6.2.1. Pre-paid à la carte (single session) appointments may be refunded in full if the request is made at least seven (7) business days prior to the scheduled appointment date.
6.2.2. Refund requests made within fewer than seven (7) business days of the appointment date are not eligible for a refund. Instead, clients may reschedule in accordance with the Cancellation & No-Show Policy.
6.2.3. If the Company cancels a session for reasons other than Client non-compliance (e.g., facility closure, staff emergency), a full refund or credit will be offered only if the Client submits a written request within three (3) business days of the cancellation notice.
6.3. Refunds for Packages and Multi-Session Deals (Subscriptions)
6.3.1. Packages (including but not limited to prepaid bundles, blocks of services, or promotional multi-session deals) are non-refundable once any appointment within the package has been redeemed.
6.3.2. Unused packages (where no sessions have been used) may be refunded in full if requested within thirty (30) calendar days of purchase.
6.3.3. After thirty (30) calendar days, all unused packages become non-refundable but remain valid for the period defined at purchase (or, if not stated, for twelve (12) months from the purchase date).
6.3.4. Packages are non-transferable and may not be sold, traded, or gifted without express written approval from the Company.
6.4. Workshops, Events, and Group Bookings
6.4.1. All group events and workshops require a non-refundable deposit of fifty percent (50%) of the total reserved services at the time of booking.
6.4.2. Cancellation or rescheduling with at least seventy-two (72) hours’ notice: While the deposit remains non-refundable, it may be applied as credit toward a rescheduled event if the event is rebooked within thirty (30) calendar days of the original date.
6.4.3. Cancellation with fewer than seventy-two (72) hours’ notice, or failure to attend: The Client will be charged one hundred percent (100%) of the reserved services.
6.5. Special Circumstances and Waivers
6.5.1. The Company reserves the right to grant exceptions in cases of verified medical emergencies, relocations outside the Seattle area, or other extraordinary circumstances. Supporting documentation may be required.
6.5.2. Courtesy waivers are discretionary and do not establish precedent for future refunds.
6.6. Acknowledgment
By purchasing, booking, or redeeming Services at Brain & Body Recess™, you agree to abide by this Refund Policy in full. This Policy is enforceable as part of the Terms and Conditions Agreement.

7. Groupon Protocol
7.1 Validity of Groupons
All Groupon vouchers presented for redemption must be valid and unexpired. Groupons that are within their validity period shall be honored strictly in accordance with the terms stated on the voucher.
7.2 Expired Groupons
In the event a Groupon has expired, Brain & Body Recess™ reserves the sole and absolute discretion to determine whether to honor such voucher. The Client acknowledges and agrees that the Company is under no obligation to accept or redeem an expired Groupon.
7.3 Redemption of Expired Groupons (If Permitted)
Should the Company, at its discretion, allow redemption of an expired Groupon, the following shall apply:
a. The Client may apply the amount actually paid by the Client for the Groupon (“Paid Value”) toward any service offered by the Company.
b. If the service selected by the Client exceeds the Paid Value, the Client shall be responsible for paying the difference at the time of booking or service.
c. If the service selected by the Client is of lesser value than the Paid Value, the Client shall not be entitled to any refund, reimbursement, or credit for the difference.
7.4 No Cash Value
Groupons, whether valid or expired, hold no cash value and may not be exchanged, refunded, or redeemed for cash, except where required by applicable law.

8. Acknowledgment & Binding Agreement
By booking, purchasing, or attending any appointment, package, event, or service with Brain & Body Recess™, you acknowledge that you have read, understood, and agreed to these Terms & Conditions in full. Continued use of our website or participation in our services constitutes your binding agreement.
